SANKSI TINDAK PIDANA PERUNDUNGAN YANG DILAKUKAN OLEH ANAK DALAM PERSPEKTIF HUKUM ISLAM

(STUDI KASUS DI SMK NEGERI 1 BANDAR BARU)

Abstract

This study aims to examine the forms of bullying that occur at SMK Negeri 1 Bandar Baru and analyze the sanctions that should be given to perpetrators from an Islamic legal perspective. The research method used is descriptive analysis with a qualitative research type. This study also uses a juridical-sociological approach. Data were obtained through observation techniques, interviews with school officials, victims, perpetrators, and local religious leaders, and documentation. The results of the study indicate that common forms of bullying include verbal, physical, and psychological bullying. In the context of Islamic law, bullying perpetrated by children is categorized as harmful and contrary to Islamic moral principles. Sanctions that can be applied to children who bully are educational (something that is educational) and restorative (recovery), such as advice, ta'zir, or religious counseling, while still taking into account the child's age and maturity level. This study recommends that schools and communities be more active in developing Islamic character, and implement humanistic-based conflict resolution mechanisms that involve families, teachers, and religious leaders.
